Medical Malpractice Insurance

With the advancement in medicine in recent decades, it has brought new knowledge, treatment methods and hope to patients. On the other hand, risks have also increased significantly.

If a patient suffers bodily injury, sickness, illness or mental injury or death after relying on the advice of the medical professional or establishment, he/she or their legal representative has the right to sue for the loss.

What is covered?

Medical Malpractice Insurance provides cover for: –

  • indemnifies the insured against legal liability for breach of professional duty in the conduct of their professional practice in respect of any negligent act, error or omission committed or alleged to have been committed on the part of the Insured
  • legal costs and expenses incurred in the defence and / or settlement of claim brought against the Insured, with the written consent of the insurer

Hospital / Nurses: A bed-bound patient fell from bed while sleeping and subsequently died. Patient’s family sued hospital and nursing staff for lack of supervision / monitoring because the bed side handle was not placed upright.

Pharmacist: Patient with high blood pressure was provide with the wrong medication that caused further aggravated to his medical condition.

What to do in the event of claim?

The insured shall give notice in writing to the insurance company immediately of any claim made against the Insured or the discovery by the Insured of any loss, or any circumstances of which the Insured becomes aware which are likely to give rise to such a claim or loss.

The insured shall not admit liability for or settle any claim or incur any costs or expenses in connection therewith without consent of the insurer.
